General Terms:
- This guarantee applies to residential real estate transactions in San Diego County only.
- This guarantee cannot be applied to situations beyond Najla’s reasonable control, such as acts of God, natural disasters, significant market fluctuations, or buyer/seller defaults.
For Sellers:
- To participate in the Commission Back Guarantee, you must sign a valid listing agreement with Najla that outlines the marketing strategy and services provided.
- If you are unhappy with Najla’s services for any reason, you must notify Najla in writing at least 5 days before the close of escrow.
- Upon receiving your written notification and if the terms of this guarantee are met, Najla will refund her commission, up to the amount of the listing commission received.
- This guarantee does not affect the buyer’s agent commission, which will still be paid by the seller.
For Buyers:
- To participate in the Commission Back Guarantee, you must sign our VIP Buyer Agreement™ which outlines the search criteria and services provided.
- Najla recommends that all buyers obtain pre-approval for financing before participating in this guarantee.
- If you are unhappy with Najla’s services for any reason, you must notify Najla in writing at least 5 days before the close of escrow.
- Upon receiving your written notification and if the terms of this guarantee are met, Najla will refund her commission, up to the amount of the buyer’s commission received.
- If you are using a mortgage, lender approval may be required to credit the commission refund to your account.

- To qualify, you must have purchased your home with Najla as your buyer’s agent and have a signed VIP Buyer Agreement™.
- The guarantee applies to single-family homes, townhomes, and condos only.
- The 12-month period starts from the closing date of your purchase.
- Najla will handle the marketing and sale of the property, but you will still be responsible for all associated selling costs (e.g., staging, photography, closing fees).
- Under this guarantee, you won’t pay Najla a listing commission, but the buyer’s agent commission may still be the responsibility of the seller.
- Najla reserves the right to refuse to sell a property under this guarantee if she deems it not to be in a marketable condition.
Buy Back Option:
- This option is entirely at Najla’s discretion and subject to prevailing market conditions.
- Najla will determine a fair buy-back price based on the current market value of the property.
- You will be responsible for all closing costs associated with the buy-back transaction.
